Trust & Estate Fiduciary Litigation

Darlene represents parties in trust and estate fiduciary litigation. This includes representing trustees, beneficiaries, and other interested parties in will contests and trust contests, undue influence claims, breach of fiduciary duty in estate or trust administration, modifications or interpretation of vague or confusing language in wills or trusts, and nonjudicial settlement agreements to resolve disputes. 

These cases may involve friends, family, or trusted caretakers in very emotionally charged situations. Disputes often center around personal property with high sentimental but low monetary value, making the dispute disproportionately costly. 

Where possible, Darlene encourages mediation and information settlement discussion.  She is familiar with local mediators and retired judges familiar with this area of law and dynamics.

Often a collaborative approach to try to reasonably resolve divided family matters can be helpful. Where the parties simply cannot get to agreement, Darlene is well versed in Oregon and Washington court probate departments and the specialized probate codes and procedural rules for trust and estate cases.
